Agreement Between User and Tilia Lime Inc

The following terms and conditions (the “Terms”, “Agreement”) govern your use of this site (the “Site”) operated by TiliaLime (“we”, “us”, “our”) and the services (the “Services”) and products (the “Products”, “Lip balm”, “Lip Scrub”, “Body products”, “TiliaLime”) provided on or though the Site that are legally binding on you. If you do not agree with any of these terms, do not access or otherwise use or purchase the services and products offered on the Site. By clicking on the “Accept” button, or by using the Site and/or purchasing the Services and Products offered on the Site, it shall be deemed to be your agreement to abide by all of the terms and conditions set forth in this Agreement. By using the Site, you are also agreeing that you are over the age of 18 and therefore able to be legally bound under these Terms.

1. Changes to these Terms and Conditions

These Terms and Conditions may be changed or updated at any time without notice based on company and customer feedback and requirements. You are encouraged to review this Agreement with every purchase you make using the Services provided on the Site. It is your sole responsibility to be aware of these changes.

2. Disclaimers

Tilia Lime products are moisturizing products made with only natural ingredients and distributed in the flavors and scents currently posted on the website. You may use this product as instructed on the container or for any other external skin application only. This way, if used appropriately, our product should act as a moisturizing agent for the user’s chapped lips, and, occasionally, cuticles and minor abrasions. We are not responsible for any unpleasant and/or unhealthy reaction to our product that may occur during improper application.

In other words, if you choose to apply our product elsewhere on the body, and choose not to notify us about potential pre-existing skin or health conditions, we will not be held responsible for the consequences. Furthermore, we are not responsible for what you or anyone chooses to do with the Products. TiliaLime Products do not officially guarantee any improvement or enhancement to your skin, appearance, or lifestyle, and are not affiliated or recognized by any established cosmetic institution.

TiliaLime Products are made solely as moisturizing and softening agents to be applied to lips and body. They contain natural and organic oils and butters, as well as cosmetic grade essential oils and lip safe micas and pigments. If you choose to apply the product elsewhere on your body, it is your responsibility to ensure that the product is compatible with your skin and health conditions (i.e. eczema), and that you are not applying it directly to an open wound. It is your responsibility to notify any other parties of these potential hazards prior to letting them use our product. We are not responsible for any damages caused by the product to any person or animal.

You agree to defend, indemnify and hold us harmless and our directors, employees, subsidiaries, agents, licensors, managers, and contractors against any and all claims, damages, obligations, losses, liabilities, costs or debts, and expenses (including but not limited to attorney’s fees) arising of (i) your use of and access to the Service or Product, including any data or content transmitted by you; (ii) your violation of any term of this Agreement; (iii) your violation of any applicable law, rule or regulation; (v) or any claim or damage that arises as a result of purchasing and/or using our Products and Services.

3. Warranty

It is very important to us that we provide you with a product that is of the highest quality. Therefore, up-on purchasing a TiliaLime Product, we will provide you with a Life-Time Warranty. This means that if your Product is damaged under the limitations set in this section of this Agreement or otherwise defected, we will send you a new Product free of charge.

Your TiliaLime Product warranty is covered under the following conditions and limitations if:

  • the Product you receive is defective, faulty or damaged when you receive it
  • the Product received water damage, the container is broken, bent, or open

Your TiliaLime Product warranty is NOT covered if you have damaged it on purpose such as, but not limited to, scratching the Product, bending the container and/or lid, melting, freezing or purposefully putting the Product under extreme conditions. We also do not replace your Product if you dislike the flavour/scent that you receive.

In order to process your warranty, contact us and include the following information:

  • a picture of the Product that clearly shows the damage or defect for us to assess the nature of the damage
  • a picture, email or a scan of your invoice which you received with your Product

If you do not have your invoice, then send us the date of purchase and the name of the person who purchased the Product.

4. Return Policy

Upon purchasing a TiliaLime Product, you will be eligible for a 30-day full refund of your Product. If within 30 days you are unhappy with your Product, please contact us. To receive your refund, you do not have to send us the Product. Please note that we do not refund based on individual flavour/scent preference.

5. Privacy

Your privacy is one of our highest priorities and we are committed to protecting it. This section applies to the https://www.tilialime.com Site and governs the service’s data collection and usage. By using the Site you consent to the data practices described below.

Collection and Use of your Personal Information

We will collect information that is identifiable (“Personal Information”) such as your name, address, e-mail address, and phone number for the purpose of billing and delivering the Products to you. We also collect anonymous information about your computer which can include your IP address, browser type, domain names, and access times. This information is used to provide us with general statistics regarding the use of the TiliaLime Site and to provide a premium quality of service.

We do not collect and have no means of using sensitive personal information regarding race, religion, or political affiliations. We do not store any credit card information. Your payment is processed through PayPal Inc. or Stripe and will be used according to their Privacy Policy and Terms of Use. We do not sell, rent or lease our customer lists or private date to any third parties.

We will disclose your personal information, without notice, only if required to do so by the law or to: (i) protect and defend the rights or property of TiliaLime; or, (ii) under demanding circumstances to protect the personal safety of other customers of TiliaLime or the public.

Use of Cookies

The TiliaLime website uses “cookies” to help personalize and ease your online experience. Cookies are text files that are places on your computer by a webpage server for the purpose of telling a server specific information about you returning to that webserver. An example is providing billing information one time, and having the computer remember this information for you so that you don’t have to re-enter this information every time. Cookies cannot be used to run programs or deliver viruses to your computer. You can change the setting on your browser to disable and delete your cookies.

Security of your Personal Information

We take great care in the process of securing your personal information from unauthorized access, use or disclosure. All of the personal information and pictures that are provided to us by you are stored in a secure server that is protected from unauthorized access, use or disclosure. Any personal information (such as a credit card number) transmitted to other websites through the TiliaLime Site is protected through the use of encryption such as the Secure Socket Layer (SSL) protocol.
